Peter Oasis.

Jan 23, 2011

w/ Loyd Banks.

(above) Peter and my brotha Anthony Kel 5mh Presidente'.

Clownin' around with my other brotha Zvi Edelman who is currently the VP of A&R at Atlantic Records.

This is an old friend of mine Peter Oasis. I was fortunate enough to have been a part of an underground Ny Hip Hop scene in a hay day from about '96 to  2000ish when in my opinion the whole "backpacker" thing died out. Point is Peter and another good friend Zvi, where responsible for a shit load of high profile shows that went down back then. And me being in the city all day and night in my summers, actin' a fool with TCK/5MH/RFC fams,  Peter was just one of the many familiar faces who would roll around with us out and about while we would just walk the ville catching tags on everything  or hangin' out outside of Bobbito's Footwork, or Fatbeats, or rollin' 40 deep to Rock Steady Anniversary, or "The Point" in the Bx to some Rap / bboy events, or over to The Nyuorican Poets Cafe to see a brawl break out.... There's just too many memories from that great era in NYC....

I bumped into Peter a couple years ago on the train goin' somewhere, and in just that minute you realize "fuck, we're all grown up, time flies"     -Anyways, I stole this interview of Vashtie's blog and like her, I thought it was pretty dope. So Peter wherever you are man, hope all is well.   And yo Zvi!  your boy in Miami should have somethin' chillin' on his office desk right about now...  ;)

MOSCOW (Reuters) – A wounded fox shot its would be killer in Belarus by pulling the trigger on the hunter's gun as the pair scuffled after the man tried to finish the animal off with the butt of the rifle, media said Thursday.

The unnamed hunter, who had approached the fox after wounding it from a distance, was in hospital with a leg wound, while the fox made its escape, media said, citing prosecutors from the Grodno region.

"The animal fiercely resisted and in the struggle accidentally pulled the trigger with its paw," one prosecutor was quoted as saying.

WE CAN TAKE IT AWAY, BUT SORRY, WE CAN’T GIVE IT BACK EVEN THOUGH WE TOOK IT AWAY WRONGFULLY IN THE END.

Thursday, January 13th, 2011

Jan 13, 2011

WE CAN TAKE IT AWAY, BUT SORRY, WE CAN'T GIVE IT BACK EVEN THOUGH IN THE END, IT LOOKS LIKE WE TOOK IT AWAY WRONGFULLY. BUT DON'T WORRY, THE FELONY WE CHARGED YOU WITH? YOU'RE NOT GONNA HAVE TO WORRY ABOUT THAT, IT'S SEEMS AS THOUGH WE WHERE WRONG ABOUT THAT ALSO."

William LeRoy of Billy’s Antiques last year, with a subway sign left behind by police officers who confiscated more than 100 from him. A judge ruled against his effort to get the signs back, but she urged the State Legislature to change the law.

A Manhattan judge this week ruled against an antiques dealer attempting to get back subway signs that the police seized from him last year in a criminal case that was eventually dismissed.

But the judge, Rita Mella of Criminal Court, did empathize with the dealer, William LeRoy, and urged the State Legislature to change the laws governing cases like Mr. LeRoy’s.

Because state law does not give criminal courts the right to return to defendants belongings seized from them under a search warrant, Mr. LeRoy may be forced to file a lawsuit to get them back, “a measure that places a substantial financial burden on that individual, and contravenes the due process rights the courts and Legislature have sought to protect,” Judge Mella wrote in a 15-page decision.

Ronald L. Kuby, one of Mr. LeRoy’s lawyers, said his client was still considering his next step. The cost of continuing the litigation would be greater than the value of the signs, which Mr. LeRoy sells from his shop, Billy’s Antiques, in Greenwich Village, Mr. Kuby said.

“People with enough property to warrant suing over will sue, and poor people lose the little that they have,” Mr. Kuby said.

Mr. LeRoy was arrested last March and charged with a felony of possession of stolen property in connection with more than 100 subway signs that were seized from his shop. Mr. LeRoy has claimed that he got the signs from a Metropolitan Transportation Authority contractor hired to dispose of them.

Prosecutors eventually dismissed the charges against him, saying they could not bring the case to trial within the legally allotted time. New York law has well established that the dismissal of criminal charges does not automatically entitle defendants to get their property back.

According to the city’s administrative code, defendants seeking to get their property back must file a claim with the Police Department’s property clerk. If the department feels that the defendant does not have a right to get the property back, it must file a forfeiture action in civil court. Or, if the department is willing to return the property, it must first get a waiver from the district attorney’s office.

In Mr. LeRoy’s case, Manhattan prosecutors indicated in court filings that they would not grant the waiver, because even though criminal charges were dropped, the rightful owner of the signs remained unclear; New York City Transit, the arm of the transportation authority that runs the subways and buses, has claimed that at least 19 of the signs were stolen.

Without that waiver, Mr. LeRoy would be left to file an Article 78 petition, a lawsuit that accuses a public official of overstepping his authority. Federal appeals courts have twice ruled that it was unconstitutional to force people to sue for the return of property. Despite those rulings, the administrative code remains the law that governs in these property disputes.

Judge Mella noted the incongruence of New York law, which allows courts to take away, but not to give back.

“By bestowing upon the Criminal Court the authority to order the police to seize property, but not vesting this court with general discretionary authority to order release of the property seized, the court is left without the power to act on or make determinations arising from its own directives,” she wrote.

In other jurisdictions and in the federal system, criminal court judges have broader discretion to allow the return of seized property to defendants.

Judge Mella’s position is perhaps best summed up in the first sentence of the second page of her ruling.

“Regrettably, and despite what this court perceives to be an unfair burden being placed upon Mr. LeRoy, his request must be denied,” she wrote.

This is the country we live in in this new century, a country we fight wars to protect,a country we are supposed to be proud of,  a court system that is so overwhelmed by its own responsibilities and red tape bullshit,  that they can't even do what's right in the end for the common man.  Unless of course you have the almighty dollar on your side to fight your battles, in which case it's not about the subject anymore it becomes about the principal.  If you have the money to fight a case it becomes "fuck that they can't push me around" instead of, " I'm right but I cant afford to prove it".

You have to be a complete idiot to not see that this country that we all love so much is falling apart at every facet, and is no longer a functional streamlined system. I personally learned this over 10 years ago when I was lost in the system for almost 2 years or court cases, minimal jail time, probation and  who knows how much wasted tax dollars spent to prosecute me for something I had a permit to do, ultimately I ended up accepting a guilty plea charge because the District attorney and the prosecuting detective railroaded my permit signer so bad with phone calls and personal visits at the job place that he was overall annoyed and scared to show up in court as a witness on my behalf. Who needs the hassle??   14 months later I was told it was in my  "best interest to cop out to the guilty charge, and the judge and D.A. won't not give me any jail time just to make all this go away" JAIL TIME, for painting a beautiful mural for the kids of an elementary school playground with 5 other top notch artists, FOR FREE! with our own time and supplies!  oh and no probation if I copped out...  when a year earlier I actually committed a misdemeanor crime and was sentenced to a year of probation and was forced to take a day off from work a month ( 12 days for the year just from court cases) to go and  put my hand in a bootleg ATM machine, get a paper print out and leave in under 5 minutes.  This pleased the courts though....     The system is so fucked and buried in paper work and red tape that it's become purely a machine to collect fine$, and dish out community $ervice ( state sentenced slavery) and fee$ to your attorney or Public Defender ( yes there actually is a fee you pay to public pretenders ).  The system just looks at you as another rotating meal ticket to feed on in an endless line, day in and day out that's  squeezed dry and forced to take endless days off from work to sit along side societies degenerates complaining about "the man, the man, holdin' us down, and what do I do with this piece of paper? Where do I go next, what department do I gotta go to get this signed? Oh they close at 1pm? I gotta come back tomorrow? AWESOME!!"

U.S.A, you're droppin' the ball, and contrary to you Tea Party idiots out there it's not the black guy's fault either,  deep down you know it isn't.... This country is fucked from the past 40 years of just gettin' by.... Now the shits hitting the fan and everyone is trying to leave the room hoping the last person in there gets blamed.

Canibus the rapper was my inspiration for this video soundtrack, his work ethic and the intelligence behind his statements are a lot of times things I can relate to personally.... Most the music I choose for the video blogs are of content that can can be applied to my life, which is why a lot, but not all of the tracks are chosen. Sometimes a classic track has no relatable relevance, but it's just a classic!  Canibus, Poet Laureate II on this Video Blog 36.

Chevy Commercial

Tuesday, January 4th, 2011

Jan 4, 2011

This was a Chevy Commercial directed by Annie Liebovitz, and at about .26 is a shot of a roll down gate I did at the Indian Larry Bike shop in Brooklyn... This doesn't show that much for me, but it's just odd to me to see these types of commercials that we all grew up watching and seeing a piece of yourself in the middle of it. I guess in some strange way I represent America, and American Culture.... I don't think this would have happened 15 years ago, and it's no accident they scouted the Bike shop that has a huge mural I painted on another wall inside.....
